Terms of Service

By accessing, browsing, or using the Red Brush platform in any capacity — whether as a homeowner submitting a project request, a painting contractor receiving leads, or a general visitor — you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Red Brush platform. Your continued use of the platform following any updates to these Terms constitutes acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you and Red Brush Painting Leads. If you are using the platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

Red Brush is a painting-specific lead generation platform that connects homeowners seeking painting services with qualified local painting contractors. Our platform provides the following core services:

• For Homeowners: A free service that allows homeowners to submit a painting project request and receive outreach from a limited number of pre-screened local painting contractors.
• For Painting Contractors: A paid lead delivery service that provides real-time notifications of homeowner painting project requests matched to the contractor's service area and specializations.

Red Brush acts solely as an intermediary. We facilitate connections between homeowners and contractors but are not a party to any agreement, contract, or transaction entered into between a homeowner and a painting contractor through or following use of our platform. We do not employ painting contractors, supervise their work, or guarantee the outcome of any painting project.

Use of the Red Brush platform is available to individuals who are at least eighteen (18) years of age and legally capable of entering into binding contracts under applicable law. By using our platform, you represent and warrant that you meet these eligibility requirements.

Painting contractors who create accounts with Red Brush are responsible for providing accurate, current, and complete information during registration and for maintaining the accuracy of that information throughout their use of the platform. Contractors are solely responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account.

Red Brush reserves the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or are used in a manner inconsistent with the intended purpose of the platform.

Homeowners who submit project requests through the Red Brush platform agree to the following conditions:

• Accuracy of information: You represent that all information submitted in your project request — including contact details, property address, and project description — is accurate, complete, and reflects a genuine intent to hire a painting contractor.
• Consent to contact: By submitting a project request, you expressly consent to be contacted by up to four (4) painting contractors matched to your request via phone, email, or SMS.
• No obligation to hire: Submission of a project request does not obligate you to hire any contractor. You retain full discretion in selecting or declining any contractor who contacts you.
• Single submission: Homeowners agree not to submit duplicate or substantially identical requests for the same project within any thirty (30) day period.

The Red Brush service is provided to homeowners at no charge. Red Brush does not charge homeowners for submitting project requests or receiving contractor outreach.

Users of the Red Brush platform — whether homeowners or contractors — agree not to engage in any of the following prohibited conduct:

• Submitting false, misleading, or fabricated project requests or account information
• Using the platform for any purpose other than its intended use as a painting lead generation service
• Harassing, threatening, or engaging in abusive communication with other platform users
• Attempting to circumvent the platform by soliciting or accepting off-platform arrangements that bypass Red Brush's lead process in bad faith
• Using automated tools, bots, or scripts to interact with the platform
• Reverse engineering, copying, or reproducing any part of the Red Brush platform without written authorization
• Using homeowner contact information obtained through the platform for any purpose other than responding to the specific lead for which it was provided
• Engaging in any conduct that could damage, disable, or impair the functionality or reputation of the Red Brush platform

Violation of these prohibitions may result in immediate account suspension, termination, and legal action where warranted.

All content on the Red Brush platform — including but not limited to text, graphics, logos, icons, images, and software — is the property of Red Brush Painting Leads or its licensors and is protected by applicable intellectual property laws.

Red Brush grants users a limited, non-exclusive, non-transferable license to access and use the platform solely for its intended purpose. This license does not include the right to reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any platform content without the prior written consent of Red Brush.

The "Red Brush" name, logo, and associated marks are trademarks of Red Brush Painting Leads. Nothing in these Terms grants you the right to use our trademarks without express written permission.

Important: Red Brush is a lead generation intermediary only. We do not perform painting services, employ contractors, or supervise any work performed. We make no representations or warranties regarding the quality, safety, legality, or reliability of any contractor accessible through our platform.

THE RED BRUSH PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RED BRUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE, EVEN IF RED BRUSH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Red Brush's total liability to you for any claim arising from or relating to use of the platform shall not exceed the total amount paid by you to Red Brush in the three (3) months preceding the claim.

In the event of a dispute between you and Red Brush arising from or relating to these Terms or the use of our platform, both parties agree to first attempt resolution through good-faith informal negotiation. To initiate this process, you must contact Red Brush at support@redbrushpainting.com with a written description of the dispute and your proposed resolution.

If informal resolution is not achieved within thirty (30) days, disputes shall be resolved through binding arbitration administered in Sacramento, California, in accordance with the rules of the American Arbitration Association. You waive the right to participate in class action litigation or class-wide arbitration.

These Terms are governed by the laws of the State of California without regard to its conflict of law provisions. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

Red Brush reserves the right to modify these Terms of Service at any time. When we make material changes, we will notify users by updating the "Last Updated" date at the top of this document and, where appropriate, by sending a notification to the email address associated with your account.

Your continued use of the Red Brush platform following the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the platform.
